Harrisburg, Pa. — A piece of legislation that has lingered in the Pa. General Assembly since early 2025 reached the finish line on July 20, receiving final approval from Gov. Josh Shapiro.
Senate Bill 349, now called Act 44 of 2026, establishes requirements for solar generation projects — including ensuring that future landowners aren’t left having to clean up defunct solar equipment.
The bill, introduced by Sen. Gene Yaw, requires decommissioning and financial requirements for solar generation projects. The proposal includes a graduated phase-in process for financial assurances, setting up five-year benchmarks using third-party professional engineers to assess and calculate fair market value for projects and costs for decommissioning.
“This new law establishes a clear framework for the responsible development of solar projects in Pennsylvania,” Yaw said. “It requires developers to plan for the full life cycle of their projects and provides greater accountability for what happens when those facilities are no longer in operation. By putting these expectations in place from the start, Pennsylvania is taking a more thoughtful and responsible approach to solar development.”
The bill received near-unanimous approval from the Senate and only had six opponents within the House. The legislation received support from the Pa. Farm Bureau and several solar associations.
According to a spokesperson from the Pa. Farm Bureau, “Senate Bill 349 is a critical step toward balancing the growth of renewable energy with the long-term interests of Pennsylvania’s farm families. By establishing clear decommissioning standards and financial protections, this legislation ensures that farmers who host solar projects aren’t left with the cost or burden of removing infrastructure when a project ends. It’s a commonsense approach that supports responsible energy development while safeguarding agricultural land for future generations.”
