The TOPCon patent fight of First Solar, a US-based PV solar technology and manufacturing company, has reached a Delaware court against JA Solar and American Panel Solutions (AMPS). Four JA Solar companies are named, among them JA Solar Vietnam, and the claim rests on US Patent No. 9,130,074. That patent covers methods of manufacturing tunnel oxide passivated contact crystalline silicon PV cells. First Solar holds it through its 2013 acquisition of TetraSun, which brought the US TOPCon patents and their international counterparts. Those counterparts reach from China to the European Union and Vietnam, with validities extending to 2030 and beyond. Having announced the portfolio and opened infringement investigations against several cell makers in July 2024, the company is now enforcing it in court. Its general counsel, Jason Dymbort, said that the suit targets the unauthorized use of First Solar’s patented technology by JA Solar and AMPS.
