Little Rock Township says its commercial solar ban ordinance is part of a return to local control of government.
Trustee Jonathan Henderson says the ordinance was passed by residents through a petition and later affirmed by the Township Board.
Henderson argues that Kendall County is still technically a township-over-county form of government because there was never a referendum asking voters otherwise.
“The General assembly cannot regulate county and township affairs from anything to marriage licenses, FOID cards town roads, laying out, opening, altering roads or highways. So, we have been a county under township form of government since 1870. That has not changed.”
Henderson says government cannot change itself because it was created by the authority of the people, and only the people can change it.
Savion Energy is currently proposing a 1,500-acre solar farm north of Plano and within Little Rock Township. Henderson says the city is aware of the ban, as is Savion.
He says if the solar farm is approved, it would be up to residents to decide what steps the township should take to potentially try to stop it, including going to court.
Plano’s city attorney has said the township’s solar ban is not valid.
