GameChange Solar Corp. has escalated its legal dispute with Nextpower Inc. by filing a patent infringement lawsuit in the United States.
The complaint, filed on September 9, 2026, alleges that Nextpower’s NX Horizon with Hail Pro single axis solar tracker infringes US Patent No. 12,449,161, titled “Self-Shielding Photovoltaic Module Tracker Apparatus”.
The patent was issued to GameChange on October 21, 2025. According to the complaint, the patented technology relates to the operation, rotation and high angle stow positioning of photovoltaic module rows in utility scale solar tracker systems.
GameChange alleges that Nextpower has infringed the patent by making, using, marketing, selling and importing the NX Horizon with Hail Pro in the United States without authorisation.
The complaint also alleges that Nextpower has encouraged customers, operators and end users to use the system in a way that infringes the patent. GameChange cited Nextpower’s marketing materials, which describe the product as offering high speed, high angle stowing, autonomous row level control and weather responsive operation.
Nextpower’s product information states that the NX Horizon with Hail Pro can stow panels at an angle of up to 75 degrees. The system is also promoted as having automated stow activation based on weather forecasts and local conditions.
GameChange is seeking a court declaration that Nextpower has infringed the patent, as well as damages, interest and legal costs. It has also asked the court to permanently prevent Nextpower and related parties from infringing the patent.
The company claims that the alleged infringement has caused irreparable harm and that it is entitled to compensation for past and ongoing infringement. GameChange sent Nextpower a notice letter on September 3, 2026, according to the complaint.
The lawsuit follows an earlier legal action involving the two companies. Nextpower, formerly known as Nextracker, has separately accused GameChange of patent infringement in a dispute involving solar tracker technology.
GameChange, founded in 2012, supplies utility scale solar racking and mounting systems and launched its Genius Tracker product in 2015. The company says it operates in 20 countries, employs more than 740 people and holds more than 40 patents and patent applications covering tracker mechanics, actuators, software and structural systems.
