A Wagoner County Judge has ordered the County Commission to issue a permit for a solar farm they denied last year.
Nextera Energy sued the Commission over the permit, which was rejected after several contentious meetings with public comment generally criticizing the project.
The plans call for a 5,000-acre solar installation spread over several square miles, near Porter, on leased land now largely used for grazing. Nextera claimed the application for a conditional use permit met every requirement and could not legally be denied, and the judge agreed. The County is allowed to impose reasonable restrictions on the permit.
Commissioner Randy Stamps said Monday, “We’ll have to do some research on where we are with the project,” and said he wanted to ensure the project didn’t leave the County on the hook for road repairs after construction. “I’ve been to those in another county, and the roads just go through a beating.”
Stamps said the County has 30 days to appeal the decision, and no deadline for issuing the permit.
When the project was proposed, Nextera projected the valuation would generate $1 million annually in taxes, largely used for local schools. The power generation would support 50,000 homes and feed into the Southwest Power Pool grid that distributes power throughout Northeast Oklahoma.
