The European Patent Office Board of Appeal, the independent judicial body, has revoked Hanwha Solutions’ EP 2 220 689 patent in full after finding that it lacked an inventive step, ending more than 11 years of opposition proceedings. Hanwha Solutions manufactures solar modules, cells and energy products through its Qcells business. The patent covered a solar cell structure using two surface-passivating dielectric layers to improve efficiency and was due to expire in 2028. REC Solar EMEA remained the sole opponent after the case initially involved ten challengers. The revoked patent had formed the basis of infringement actions against REC, Longi Solar and Jinko Solar across Europe. The decision removes the patent’s legal protection before its scheduled expiry and concludes one of the solar industry’s most significant patent disputes.
