The global solar manufacturing landscape has faced significant legal scrutiny following a series of patent infringement complaints. The U.S. International Trade Commission (USITC) had initiated a Section 337 investigation in March 2026, targeting imports of TOPCon solar cells and modules. The investigation was triggered by a complaint from First Solar, which alleged that various manufacturers were infringing upon its U.S. patent claims related to TOPCon technology—a high-efficiency cell architecture currently dominating the global market.
In a significant development, the USITC has officially terminated its investigation against Philadelphia Solar USA and Trina Solar. This decision followed a formal request by First Solar in June 2026 to withdraw its complaint against these specific entities. The Commission opted not to review an administrative law judge’s initial determination, effectively closing the case for these two respondents. The Office of Unfair Import Investigations had previously supported the motion for termination in a filing dated June 18, 2026.
The original scope of the investigation was extensive, naming numerous global manufacturers including Canadian Solar, JA Solar, JinkoSolar, Runergy, Hanwha Q CELLS, Adani Group companies, Toyo, and VSUN. Notably, Mundra Solar Energy and Adani Green Energy had already been removed from the investigation earlier, following similar withdrawals by the complainant. The investigation spanned respondents across multiple regions, including India, China, Vietnam, Thailand, Malaysia, and South Korea.
For Indian EPC contractors and solar developers, the legal volatility surrounding TOPCon modules has been a point of concern for project procurement strategies. As TOPCon technology becomes the standard for high-efficiency utility-scale projects, any disruption in the supply chain—whether through trade barriers or patent litigation—directly impacts project timelines and capital expenditure. The termination of these specific probes provides a measure of relief, signaling a potential cooling of legal hostilities that could otherwise constrain the availability of advanced modules in the Indian market.
While the probe against Trina and Philadelphia Solar has ended, the broader context of global trade and manufacturing policy remains complex. The U.S. Trade Representative is concurrently conducting a Section 301 investigation into structural excess capacity in manufacturing, which includes an assessment of Indian policies. As the India renewable energy sector continues to scale its domestic manufacturing capacity under the PLI scheme, developers must remain vigilant regarding both international patent landscapes and evolving trade policies that could influence the cost and accessibility of high-efficiency solar components.
