Tiverton Planning Board Hearing on Nanaquaket Road Solar – Uprise RI

The Tiverton Planning Board will hold a public hearing Nov. 10 on a proposed 45-panel, 936-square-foot solar array at 575 Nanaquaket Road, with a possible vote that night.
Tiverton residents can attend the Nov. 10 hearing or email comments before the board possibly votes on the Nanaquaket Road solar plans.
— The Tiverton Planning Board will hold a public hearing Tuesday, Nov. 10, at 6:30 p.m. at Tiverton Town Hall on a proposed ground-mounted solar array at 575 Nanaquaket Road. The board could also vote that night, according to a notice the town posted Oct. 28.
The notice describes the project as an "Agricultural Accessory Ground Mount Solar Array" made up of 45 panels covering 936 square feet. The town lists the parcel as 29.204 acres, Plat 404, Lot 101, in the R-120 zoning district. The applicant is listed as Eva Longobardi of 575 Nanaquaket Road.
The agenda item is a combined review of the project's master plan and preliminary plan. The notice's action line reads: "Discussion and possible vote on the combined Master and Preliminary plans." A possible vote means the board may decide on Nov. 10, but it is not required to.
The town classifies the application as a "Major Land Development." Under Rhode Island's land development law, R.I. Gen. Laws § 45-23-39, major projects move through three stages: a master plan, which sets out the basic concept; a preliminary plan, with more detailed engineering; and a final plan.
The statute allows a planning board to combine stages once the town's administrative officer finds the requirements are met. It also requires a public hearing at the master-plan stage, or during the combined stage when stages are merged, which is why this item carries a hearing.
If the master plan is approved, the law describes later review steps for the project. None of those steps had been scheduled in the town's notice.
The notice also prints a review deadline: "95 Days = February 6, 2027." That is the date by which the board's time clock, as printed by the town, runs out.
Tiverton adopted its first solar ordinance in March 2018 and repealed it that November. The town's zoning rules now include a category for agricultural accessory ground-mounted solar, the label the notice uses for this project.
The notice says anyone who wishes to be heard should attend the hearing or file a written appearance on or before Nov. 10. Public comment may be emailed to [email protected], the address printed in the notice.
The application and plans are available for review at the Planning Office at Town Hall, 343 Highland Road, before the hearing. The notice lists Town Planner and Administrative Officer Christopher Spencer as the contact, at (401) 816-5631. People who need interpreter services should call the same number at least 72 hours before the meeting.
The town says Planning Board meetings are recorded and posted to YouTube, sometimes with a delay. The full hearing notice is posted on the town's website.
The hearing begins at 6:30 p.m. Nov. 10 at Tiverton Town Hall.
